The legally elected woman MP for Mityana – Court is Joyce Bagala Ntwatwa.
The validly elected Mityana Woman MP, Hon. Joyce Bagala Ntwatwa, has been confirmed.
On Friday morning, the Court of Appeal overturned the High Court judgment that had declared Bagala’s win invalid.
Lands Minister Judith Nabakooba disputed her election victory on the grounds of corruption.
Bagala was expelled from Parliament by the High Court in Mubende last year due to allegations of voter bribery, double voting, and disregard for the law of elections.
But this morning, a panel of three justices—Geoffrey Kiryabwire, Stephen Musota, and Christopher Gashirabake—ruled that Nabakooba had not shown sufficient proof of electoral fraud.
The justices clarified that both the quantitative and qualitative standards should have been used in the filing of Nabakooba’s non-compliance with electoral regulations, stating that it was incorrect for the lower court to declare her election invalid.
“The claimant failed to demonstrate how non-compliance would have altered the results of the election. The trial court’s judgment to declare the appellant’s election as the Woman Member of Parliament for the Mityana District invalid is overturned, the justices declared, upholding the main appeal.
Costs have been assessed against the minister.
